I’ve been in Nigeria for over three years now, selling off-grid solar systems from my small warehouse in Ibadan. My team is four people — me, one local sales rep, a part-time driver, and a cousin who handles WhatsApp customer service. We’re not a company. We’re a survival operation.

But last month, I got a warning from a local pharmacist I’ve known since 2023. “Your solar inverter ads on Facebook say ‘cures power-related nerve damage’ — that’s not just risky. It’s illegal.”

I didn’t even realize I’d crossed a line.

I thought I was just being helpful: “Our solar systems stabilize voltage — so your fridge doesn’t die, your phone doesn’t fry, and your epilepsy monitor keeps running.” That’s true. But in Nigeria, especially in Ibadan, saying a medical device “prevents” or “treats” illness — even indirectly — triggers strict advertising controls under the National Agency for Food and Drug Administration and Control (NAFDAC) and the Medical and Dental Council of Nigeria (MDCN).

This isn’t about fines. It’s about trust. And that’s what I want to break down here.


一、表层现象:医疗广告被“误伤”的太阳能产品

在尼日利亚,尤其是西南部的伊巴丹(Ibadan),任何与“健康”“治疗”“诊断”相关的词汇,哪怕只是暗示,都会被执法部门高度警惕。

“No more blackouts during dialysis sessions. Our battery keeps your kidney machine running.”

“Stable power = fewer seizures for epileptic children.”

These are true benefits. But under Nigerian law, they’re classified as medical claims.

I learned this the hard way. A competitor filed a complaint with NAFDAC’s Ibadan office. They didn’t accuse me of selling fake goods. They accused me of unauthorized medical advertising — even though I sell batteries, not medicine.

The result? My ads were taken down. My Facebook page was flagged. My local distributor got nervous and stopped promoting us.

This isn’t unique to me. In the last six months, at least three Chinese solar brands in Ibadan have had similar issues. One had their warehouse raided by NAFDAC officers because a product manual mentioned “reducing stress on cardiac patients during power outages.”

The surface problem:

You’re not selling medicine — but your marketing language is being treated like you are.


二、隐藏变量:法律执行背后,是“信任赤字”与“信息不对称”

为什么尼日利亚对医疗广告如此敏感?

这背后不是“官僚主义”,而是历史创伤。

  • 一个家用血糖仪,是医疗器械。
  • 一个能稳定电压的逆变器,不是。
  • 但如果你说:“This device prevents diabetic complications from power outages,” —— 到老百姓耳朵里,它就是“能治病的机器”。

而在这个国家,信任是稀缺品

同样的逻辑,也适用于商业环境。

当一个本地人看到“中国制造”的产品宣称能“治疗癫痫”,他的第一反应不是“这很聪明”,而是:“这又是骗人的吧?”

所以,执法部门的反应不是针对你,而是针对整个“外国品牌说健康功效”的历史模式。

隐藏变量一: 法律执行的强度,和公众对“外国健康产品”的信任度成反比。
隐藏变量二: 你越想“讲效果”,越容易触发监管反应。


三、制度逻辑:Nigerian Advertising Law —— 不是“禁止宣传”,而是“禁止误导”

我查了《Nigerian Advertising Practice Code》(2020年修订版)和 NAFDAC 的《Guidelines on Advertising of Medical Products》(2023版)。

它们没有说:“不能提健康好处。”

它们说:

“Advertising must not imply that a product can diagnose, treat, cure, or prevent any disease unless it is registered as a medicinal product or medical device under the Act.”

换句话说:
✅ 你可以说:“Our battery ensures uninterrupted power for home medical equipment.”
❌ 你不能说:“Our battery cures epilepsy.”

这不是“反创新”,而是“反欺诈”。

在尼日利亚,法律不是障碍,而是过滤器

它过滤掉那些想用“健康话术”卖普通商品的人,保护真正合规的医疗品牌。

所以,真正的问题不是“能不能说健康”,而是:

你有没有把“产品功能”和“医疗效果”区分开?

我后来重新写了所有文案:

  • 原文案:“Stable power = fewer seizures”
  • 新文案:“Our system maintains consistent voltage output, reducing the risk of power surges that may interrupt critical medical devices.”

听起来更啰嗦?是的。但没人投诉了。

制度逻辑的本质:

在信息不透明、监管资源有限的市场,法律必须用“禁止式语言”来防止伤害。你不能靠“聪明表达”钻空子,你必须用“清晰结构”来证明你不是在骗人。


四、创业者视角:我该如何在Ibadan合规推广?

我问过一位在拉各斯执业的本地律师(通过律咖网社群推荐,非广告),他给我三条路径:

✅ 路径一:改文案 —— 用“设备支持”代替“健康结果”

步骤:

  1. 列出你产品所有“健康相关好处”
  2. 把“治疗/预防/缓解”等词,全部替换为:“支持”“维持”“确保”“减少干扰”
  3. 加一句免责声明:“This product is not a medical device. Consult your doctor for medical advice.”

要点清单:

  • ✅ 支持:supports, enables, maintains, ensures
  • ❌ 禁止:cures, treats, prevents, reduces risk of disease, improves health

✅ 路径二:注册为“辅助医疗设备”(Class I Medical Device)

虽然我的产品不是器械,但如果你的产品直接连接医疗设备(比如为呼吸机供电),你可以考虑申请 NAFDAC Class I Medical Device Registration

路径:

  1. 联系 NAFDAC Ibadan Office(地址:No. 15, Oba Akinjobi Street, Ibadan)
  2. 提交:产品说明书、电路图、安全认证(CE/UL)、使用场景说明
  3. 支付约 ₦150,000–₦300,000(约 $100–$200)
  4. 等待 4–8 周

✅ 路径三:与本地医疗从业者合作背书

  3. 优先选择“用户证言”而非“产品功能” —— 本地人更信邻居,不信广告。
  4. 每季度花 2 小时,联系一次 NAFDAC Ibadan 或 Lagos 办公室,确认你的文案是否仍合规。政策可能微调,但没人会主动通知你。
